Terms of use (EULA)
Welcome to https://www.fifsee.com (the "Site"). Fifsee Inc. (referred to as "Fifsee", "we", "us" or "our", as applicable) provides you with access to the Site subject to the terms and conditions contained in this Terms of Use Agreement (the "Agreement'). Please read this Agreement carefully. By accessing or using this Site, you agree without restriction to be bound by this Agreement. If you do not agree to follow and be bound by and this Agreement, you may not access, use or download and install.
Please note that if you are a new user, existing user or 3rd party business user of Fifsee, these terms are not intended to replace or modify those contained in your customer or vendor agreement. In case of an inconsistency, the terms and conditions of your written agreement will prevail over those contained herein. All services offered by Fifsee may also be subject to separate terms and conditions which govern their use.
Fifsee reserves the right to update or modify this Agreement at any time without prior notice. Your use of this Site following any such change constitutes your agreement to follow and be bound by this Agreement as revised. For this reason, we encourage you to review this Agreement each time you use this Site. This Agreement was last revised on Sep 28, 2021.
Billing and Cancellation
Billing Cycle. The membership fee for Fifsee and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "Subscription" page under the App Settings. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the fifsee service. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid membership began on a day not contained in a given month. We may authorize your Payment Method in anticipation of membership or service-related charges through various methods, including authorizing it up to approximately one month or one year of service as soon as you register.
Payment Methods. To use the Fifsee service you must provide one or more Payment Methods depending on your mobile device. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details based on your mobile device.
Auto renewal. The Subscription commences on the day that You a) enroll in Fifsee as per your subscription choice; b) pay the initial payment due for the Subscription. The Subscription automatically renews after its duration. You will be required to make all payments due during the duration of the Subscription regardless of whether You choose to access Fifsee, or use the Services You agreed to in the Subscription Agreement. Your subsription that you enroll will be auto renewed as per the package you choose.
Updating your Subscription. You can update your Subscription by going to the "Account" page. Following any update, you authorize us to continue to charge the applicable Payment Method(s) via your service provider based on your device.
Cancellation. You can cancel your Fifsee membership at any time, and you will continue to have access to the Fifsee service through the end of your billing period. To cancel, go to your device service provider and cancel the subscription. If you cancel your subscription, your account will automatically close at the end of your current billing period.
Changes to the Price and Subscription Plans. We reserve the right to change our subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes or changes to your subscription plan will take effect following notice to you.
No Refunds. Payments are nonrefundable and there are no refunds or credits for any payments that are already processed, or any partially used membership periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period.
The availability of the site and international users
The Site is administered by Fifsee, A Delaware Corp in the United States. This Site and its contents (the "Content") are designed to comply with United States laws and regulations and are intended for use by United States residents only. Access to the Site and the Content may not be legal by certain persons or in certain countries outside of the United States. If you access this Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
Materials published on this Site may refer to products or services that are not available in your country. Consult your local Real Estate attorneys for more information. Furthermore, Fifsee makes no representation that the materials on the Site are appropriate or available for use at other locations outside of the United States and access to them from countries where their contents are illegal is prohibited.
You should not construe anything on the Site as a promotion or solicitation for any product or for the use of any product that is not authorized by the laws and regulations of the country in which you are located.
This site is not a source of Real Estate Sales
We are not Real Estate Professionals. We neither buy nor sell the properties from Fifsee app. The Content of this Site or App is presented as ‘Platform’, is general in nature, and is provided for the customers; we DO NOT fact check any listings in Fifsee App. Use Fifsee as just a chat platform and consult with any Real Estate professional or Listing services such as MLS to validate about any property(s) that you may be interested in purchasing or selling. You should NOT use the Chat services and share any personally identifiable information such as Full name, Date of Birth, Social Security number or Tax ID number etc. to anyone at anytime.
Nothing contained on this Site or App is intended for Sale or purchase of a property. Never disregard or delay in purchasing or selling a property because of something you may have read on this Site or App.
Copyright notice and limitation on use
No use should be made of materials on this Site, except as expressly authorized by this Agreement. All Site or App Content, including the selection, arrangement and design of the Content is owned either by Fifsee and is protected by copyright and other intellectual property laws.
You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any Content, in whole or in part, including any code and software. You may download Content from the Site or App for your own personal, non-commercial use only, provided the Content is not modified in any way you keep intact all copyright and other proprietary notices and you include the phrase, "Used with permission of Fifsee" when you display or otherwise use the Content.
Trademark
All of the trademarks, service marks and logos displayed on this Site (the "Trademark(s)") are registered and unregistered trademarks of Fifsee Inc.
Public and unsolicited information
This Site may provide opportunities to provide Fifsee feedback regarding this Site, App and our products and other unsolicited submissions (collectively, "Unsolicited Information"). You may only provide Unsolicited Information which meets the requirements of these Terms and Conditions.
Fifsee and its employees do not accept or consider other unsolicited ideas, including ideas for new advertising campaigns, new promotions, new products or technologies, processes, materials, marketing plans or new product names. Please do not send any original creative artwork, samples, demos, or other works.
You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate the law. Fifsee will fully cooperate with any law enforcement authorities or court order requesting or directing Fifsee to disclose the identity of anyone posting any such material.
Children under the age of twenty-one should NOT submit any Information containing any personally identifiable data
Third party Sellers - Links to other websites
The Third-Party Sellers such as Lenders or any Real Estate Merchants (and any Web sites to which they link) are required to provide your MLS/ License ID during your profile setup in Fifsee. This is required if a Customer wants to work with you.
The Third-Party Sites (and the Web sites to which they link), MLS/ License ID may contain information that is inaccurate, incomplete, or outdated. Your access and use of the Third-Party Sites (and any Web sites to which they link) is solely at your own risk.
Dealings with advertisers, Third party Sellers or Merchants
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings are solely between you and such advertiser. You agree that we, Fifsee are not responsible nor shall we be liable for loss or damage of any sort incurred as a result of any such dealings or as the result of the presence of such advertiser on the Site.
Profile registration
The functions of Fifsee app or site requires creation of an account with us. As part of the registration process, customers will select a User Name/ Email id and Password, along with registration information, which must be accurate and updated. You may not select or use a User Name/ Email id of another person with the intent to impersonate that person or use a User Name in which another person has rights without such person's authorization.
Failure to comply with the above shall constitute a breach of this Agreement, which may result in immediate termination of your account. You agree to take reasonable measures to protect the security of your password. You are responsible for all usage or activity on your account, including use of the account by any third party authorized by you to use your User Name and Password. You shall notify Fifsee of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or any other relevant registration details provided.
Fifsee App/ Site Privacy Statement
Our Privacy Statement is available on this Site and by accessing the Site, you are agreeing to be legally bound by the Privacy Statement. The Privacy Statement in its entirety is hereby incorporated into this Agreement by reference.
